29. Liability Waiver*

    I, on behalf of myself, and my heirs, executors and administrators, hereby waive, release, and discharge the Borough of West Chester and its public officials, officers, employees, including fire and police personnel, and agents (collectively the “Borough”) from and against all claims, actions or liabilities of any kind arising out of my activity taking place upon Borough owned property and/or during the above referenced Borough event, including without limitation for any injury, harm or death, damages, loss or inconvenience related to such activity. I agree to indemnify, save and hold harmless the Borough from any and all loss, damage or cost which may incur as a result of any such claim, action or liability. I agree that I will not sue and will hereby release and forever discharge, indemnify, and hold harmless the Borough and its respective officials, officers, employees, and agents from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, that arise or may hereafter arise from the above referenced activity. I assume all risks of injury associated with my activity. I agree that this Release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Pennsylvania, and that this Release shall be governed by and interpreted in accordance with the laws of the Commonwealth of Pennsylvania. I agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
